1. Licence
EpisodePal grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control for personal, non-commercial use.
If you downloaded the app through the Apple App Store, your use of the app must also comply with the Apple Media Services Terms and Conditions, including the App Store Usage Rules.
Your use of EpisodePal’s online services is also governed by the EpisodePal Terms of Service and Privacy Policy.
2. Ownership
The app, including its code, design, branding, features, interfaces, graphics, text, and related intellectual property, remains the property of EpisodePal or its licensors.
This agreement does not transfer ownership of the app or any intellectual property rights to you.
All rights not expressly granted to you are reserved by EpisodePal.
3. Restrictions
You may not:
- copy, modify, adapt, translate, or create derivative works of the app
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
- distribute, sell, rent, lease, sublicense, transfer, or make the app available to others
- remove or alter proprietary notices
- misuse the app or use it to interfere with EpisodePal or third-party systems
- use the app in violation of applicable law
- use the app to infringe the rights of EpisodePal, users, or third parties
These restrictions apply except to the extent they are prohibited by applicable law or permitted by licences for open-source components included in the app.
4. Service limits, updates, and changes
We may provide updates, fixes, improvements, or changes to the app.
We may apply technical limits, security protections, access restrictions, maintenance, updates, and changes as needed to operate, protect, or improve the app and related services.
Some features may change, become unavailable, or depend on third-party services.
5. Third-party services and metadata
EpisodePal may depend on or display third-party services, APIs, metadata, databases, images, links, and other third-party content.
Third-party services and content are provided by their respective providers and remain subject to their own terms, licences, and privacy policies.
EpisodePal is not responsible for third-party services, content, availability, accuracy, legality, policies, or changes.
Show, episode, release-date, streaming-availability, recommendation, artwork, rating, and other metadata may be incomplete, delayed, unavailable, or inaccurate.
6. Data
EpisodePal may collect and use technical, diagnostic, usage, and related information as described in the Privacy Policy.
This information may be used to operate, maintain, protect, support, and improve the app and related services.
Your use of EpisodePal is also governed by the Privacy Policy.
7. Termination
This licence ends if you stop using the app or if we terminate your access because this agreement or the Terms of Service were violated.
After termination, you must stop using the app and delete any copies in your possession or control.
Sections that by their nature should continue after termination will continue to apply, including ownership, restrictions, disclaimers, liability limits, and governing law.
8. Disclaimers and liability
The app is provided “as is” and “as available.”
To the maximum extent permitted by law, EpisodePal disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, quiet enjoyment, and non-infringement.
To the maximum extent permitted by law, EpisodePal is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, service interruption, device issues, or business losses, arising from or related to your use of or inability to use the app.
Nothing in this agreement excludes or limits liability that cannot legally be excluded or limited.
9. Export control and sanctions
You may not use, export, re-export, import, or transfer the app except as permitted by applicable export control and sanctions laws.
You represent that you are not located in a country or territory subject to applicable embargoes or sanctions and are not on any applicable restricted-party list.
You also agree not to use the app for purposes prohibited by applicable law, including the development, design, manufacture, or production of weapons or other restricted uses.
10. Apple App Store terms
If you downloaded the app through the Apple App Store, this agreement is between you and EpisodePal, not Apple.
Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
To the extent any warranty applies and has not been disclaimed, Apple’s only warranty obligation is to refund the purchase price, if any, as required by applicable App Store rules.
Apple is not responsible for claims relating to the app, including product liability claims, legal or regulatory claims, consumer protection claims, or intellectual property infringement claims.
Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce this agreement against you.
11. Governing law
This agreement is governed by Swiss law.
Disputes are subject to the courts of Zurich, Switzerland, except where mandatory consumer protection laws provide otherwise.
